Welcome to First10K. Your use of this website, browsing of the website, and any purchases made through it are subject to these Terms of Service. By using the website or placing an order, you confirm that you have read and understood these Terms and agree to be bound by them, subject to any rights that cannot legally be limited or waived under applicable law. First10K is a savings challenge and a tool for tracking progress toward a goal of $10,000. First10K is not a bank, financial institution, savings account, investment service, or financial advisory service, and does not hold, manage, or invest users’ savings. The $10,000 amount represents the goal of the challenge only and is not a guaranteed result. Completion of the challenge and the amount each user actually saves depend on their individual circumstances, decisions, and actions. Nothing on the website, in the product, digital files, advertisements, or First10K social media content constitutes financial, investment, tax, or credit advice, or a recommendation to borrow money, incur debt, or take any particular financial action. Through the Choose Your Price option, customers may select the purchase price starting from the minimum price displayed on the website, which at the time these Terms are published is $35 unless otherwise displayed on the website. The amount selected by the customer is the purchase price and is not a donation. Paying a higher amount does not provide a different product, additional service, or other benefit unless expressly stated on the website, and does not guarantee greater commitment, motivation, savings, or success. First10K offers a physical product that can be used as a visual tool for tracking progress throughout the challenge. Customers may choose between the SOLO, RACE, and TOGETHER challenge options. SOLO is intended for an individual completing the challenge personally. RACE allows participants to compete with one another in their progress toward the goal; any prize, wager, commitment, transfer of money, or private arrangement between participants is solely their responsibility and is not associated with First10K. The purchase of one unit includes one physical product only. Therefore, if multiple RACE participants would each like their own physical product, the appropriate number of units must be purchased. TOGETHER is intended for couples, families, friends, or groups who wish to work toward a shared goal. First10K does not hold or manage participants’ money and is not responsible for the division or ownership of funds, agreements, or disputes between participants. A purchase may include a printable digital file based on the selected challenge option. First10K digital files and content are intended for personal, non-commercial use only and may not be copied, sold, distributed, or used commercially without appropriate authorization, except where permitted by law. Intellectual property rights in original First10K content, including the brand name, text, graphics, files, and digital materials created by First10K, belong to First10K or are lawfully used by First10K, as applicable. Nothing in these Terms claims ownership by First10K of intellectual property rights, designs, products, or materials belonging to third parties. Users agree to use the website and services only for lawful purposes and not to engage in any activity that may harm the website, other users, or the rights of any third party. When placing an order, customers are responsible for providing complete, current, and accurate information, including their name, shipping address, email address, and required payment information. Product prices are displayed in the currency indicated at the time of purchase and may change from time to time. First10K may correct errors in pricing, product descriptions, or other information displayed on the website and, where appropriate and permitted by applicable law, may cancel an order placed as a result of a material error and refund the amount paid. Product availability may change, and First10K does not guarantee that any particular product will remain available at all times. Shipping is subject to the Shipping Policy published on the website, while returns, cancellations, and refunds are subject to First10K’s Returns, Cancellations & Refund Policy and applicable law. Where a refund is approved for a purchase made through Choose Your Price, the refund amount will be based on the amount actually paid, in accordance with the refund policy and applicable law. The use of personal information is governed by the website’s Privacy Policy. First10K may use third-party providers for payment processing, website hosting, order processing and fulfillment, shipping, tracking, email communications, and other services necessary to operate the store. The use of certain services may also be subject to the terms and policies of those third-party providers. Links to third-party websites or services may appear on the website, and First10K is not responsible for the content, policies, or activities of those third parties beyond any responsibility that cannot legally be limited. Reviews, success stories, examples, results, or customer content appearing on the website or in First10K promotional materials do not guarantee that another user will achieve the same or similar results. Each user is responsible for deciding how much money, if any, is appropriate for them to save based on their individual circumstances. There is no need to borrow money, incur debt, or put essential needs at risk in order to participate in the challenge, and First10K does not encourage doing so. To the extent permitted by applicable law, First10K will not be liable for indirect losses or damages arising from a user’s personal financial decisions or failure to achieve the savings goal. Nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded. First10K may update, modify, suspend, or discontinue portions of the website or services from time to time and may also update these Terms. Where changes are made, the updated version will be published on the website and will take effect in accordance with applicable law. If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent possible. In the event of any conflict between these Terms and a mandatory provision of applicable law governing a transaction, the mandatory provision of law will prevail.
